Rape and sexual activity seriously reduces the mission of the Gem County Sheriff’s Office to prevent crime and provide quality criminal justice service. In accordance with the Prison Rape Elimination Act of 2003, the Gem County Detention Center has established a zero tolerance standard regarding the incidence of rape and sexual activity. With this policy, the Gem County Detention Center has established practices that will attempt to abate any incidence of rape or sexual activity within the Detention Center. All allegations of rape or sexual activity will be investigated. Any allegations that are deemed criminal in nature upon an initial internal investigation will be referred to an outside agency with the legal authority to conduct criminal investigations.

In compliance with Section 115.22 of the Prison Rape Elimination Act (PREA) Standards, the Gem County Detention Center has provided policies to ensure either administrative or criminal investigations are completed on all allegations of sexual abuse or sexual harassment, or they are referred for investigation.

The Gem County Detention Center will initiate either an administrative or criminal investigation as soon as possible after the report of sexual harassment or sexual assault of an inmate or staff member. Allegations that involve potentially criminal behavior will be investigated by an agency with the legal authority to conduct criminal investigations.
 
POLICY & PROCEDURES for REPORTING ABUSE
If you suspect sexual abuse or sexual harassment has happened at the Gem County Detention Center, you may call the Jail Administrator, Commander Rolland at 208-365-4484 or 208-477-2209, or you may call The Sheriff Department Investigator at 208-365-3150, or Sheriff Rolland at 208-477-2026.  Please have any information or evidence available for the investigator who will be assigned to handle the case.  False accusations may be prosecuted.  All reports are taken seriously and investigated as outlined in PREA.

IPREA Policy No. 18.6 – Official Response Following Report: The Gem County Detention Center shall require all employees accept all reports from inmates and report all incidents of sexual abuse/harassment, retaliation, or neglect of responsibilities to detect, prevent, or report sexual abuse. IPREA Policy No. 18.7 – Investigations: The Gem County Detention Center shall ensure that all allegations of sexual abuse, sexual harassment, and/or staff misconduct are referred for immediate administrative and/or criminal investigation immediately upon receipt of knowledge of an incident. DATA REVIEW for CORRECTIVE ACTION & PUBLICATION
In compliance with Section 115.88 of the PREA Standards, the Gem County Detention Center has reviewed data collected and aggregated, pursuant to Section 115.87, in order to assess and improve the effectiveness of its sexual abuse prevention, detection, and response policies, practices, and training, including:
  1. Identifying problem areas;
  2. Taking corrective action on an ongoing basis; and
  3. Preparing an annual report of its findings and corrective actions.
Also, in compliance with Section 115.89 of the PREA Standards, the Gem County Detention Center shall make aggregated sexual abuse data readily available to the public at least annually.
